Isaac, now a Category 1 hurricane packing 80-plus-mph winds and torrential rains, has begun its assault on the northern Gulf Coast.

The center of the storm is scheduled to make landfall near flood-prone New Orleans late Tuesday or early Wednesday. Storm warnings and watches stretch across Florida, Alabama, Mississippi and Louisiana.

Whether it?s the rise and proliferation of infographics from media buzzword to bestselling book, or the first Data Journalism Awards this year, data visualisation now pervades almost all disciplines, employed and celebrated as a means of conveying information effectively.

It came as no surprise, then, that the topic was turned on its head at this year?s Campus Party Europe in Berlin, Germany. Billed as ?the biggest electronic entertainment event in the world?, the festival is a week of tech-related talks and workshops with 10,000 participants - in the words of keynote speaker, World Wide Web inventor Tim Berners Lee, ?a hackathon gone big?.

On Wednesday last week, a trio from the Copenhagen Institute of Interactive Design (CIID) in Denmark demonstrated their Tasty Tweets project. According to students Kat Zorina, Ruben van der Vleuten and Kostantinos Frantzis, data visualisation is all well and good, but some of it is - quite frankly - boring. ?Some infographics are practical but don?t really trigger action,? said van der Vleuten. ?We wanted to move away from these conventions and take a more tangible approach?.

The Tasty Tweets software scans Twitter 100 tweets at a time, searching for mentions of specific fruit names - tonight it was apple, orange, pineapple and cranberry. The proportions of each are used to trigger valves in vessels containing the corresponding fruit juices. The resulting Twitter smoothie collects in a glass below as a gustatory representation of the initial data.

The CIID team envision developing their project to be applied to the quantified self movement, which strives for ?self knowledge through numbers?, by generating drinks based on individuals? nutritional requirements at any given time. An audience member, however, had other ideas - namely a bar that facilitates truly social drinking by creating beverages based on guests? online interactions.

Twitter may taste fruity for now but what does it sound like? I found out on Saturday, when British duo Daniel Jones and Peter Gregson presented The Listening Machine - an automated online system that generates wholly digitally native compositions based on Twitter activity.

Like their contemporaries at CIID, Jones, a music artist and programmer,and Gregson, a cellist and composer, wanted to overcome the static nature of traditional data visualisation and were keen to add flow and a human element by incorporating sound. They noticed that Twitter data is often referred to in a similar way to music, with words like ?orchestration? and ?volume? constantly overlapping.

?Music can be used to more accurately represent digital human interactions and reflect the dynamics of conversations.? Gregson explained. To avoid dealing with the sheer mass of data generated by Twitter, they draw from a selection of 500 users involved in a spectrum of social life. Sponsored by the BBC for multimedia platform The Space, the topics covered correspond with the BBC?s own categories, with 10 per cent of users each involved in sports, technology, arts, politics, health, business and science, and the remaining 20 per cent selected at random. These 500 tweeters are followed throughout the six-month project and remain unaware of their participation.

The Listening Machine gauges the sentiment of tweets, and their rate and subject matter. Scanning for emoticons and adjectives, the sentiment is translated into major, minor and modal chords depending on whether the mood is happy, sad or neutral respectively.? The rate of tweets determines the tempo of the composition, and the topics themselves also have a specific sound. The rhythm of the music is dictated by the rhythm of tweeted sentences.

The artists mapped the vowel sounds of the English langauge's 1000 most used words onto musical phrases, which were then painstakingly played by musical ensemble Britten Sinfonia?s instruments. ?We had a room full of accomplished musicians playing ridiculously easy music. People started to make mistakes through sheer boredom.? laughed Gregson.

Launched in May, The Listening Machine was built in six weeks straight, but like the tweets it captures, it has a short life, coming to an end on 31 October. However, Jones and Gregson plan to go on tour with the orchestra, who will play live to a score generated on-screen, potentially bringing in an added dimension to the work by using a sample of location-specific Twitter accounts for every tour date.

Romney to fly to Tampa Tuesday, ahead of wife?s convention speech

BOSTON?Mitt Romney will fly to Tampa Tuesday, arriving in town just hours before his wife, Ann Romney, is expected to address the Republican National Convention.

The Romney campaign declined to say on the record what the presumptive Republican nominee will be doing in Tampa. But he's arriving in Florida two days earlier than expected.

Romney had been expected to touch down on Thursday, the day he is scheduled to accept the Republican presidential nomination. But his campaign abruptly announced a change of schedule late Monday, informing reporters he would fly early Tuesday morning to Tampa instead.

The GOP candidate is presumably heading to Tampa to hear his wife speak, although several aides declined to confirm that on the record. On Wednesday, Romney is scheduled to make a speech to the American Legion in Indianapolis.

ScienceDaily (Aug. 24, 2012) ? Cytomegalovirus (CMV) is one of the viruses that most infected people carry without ill effects. Once infected you are infected for life and, although it normally is dormant, it can become active again at any point in time. New research published in BioMed Central's open access journal Immunity and Ageing shows that CMV infection is a significant risk factor for the type 2 diabetes in the elderly.

Obesity, inactivity and aging are known to be associated with insulin resistance, one of the first signs of incipient diabetes. However only a third of those with insulin resistance go on the develop type 2 diabetes. So what marks these people as different? Why do their pancreas' fail? Genetic and environmental factors are thought to play a part but so also does inflammation. People with type 2 diabetes usually have raised levels of biological markers for inflammation such as elevated CRP and larger numbers of active white blood cells.

Chronic infections including CMV can 'stress' the immune system and when researchers from Leiden University Medical Centre and University of Tubingen Medical School compared glucose regulation with antibodies to CMV (or CMV seropositivity) in over 500 participants of the Leiden 85-plus Study they found that having CMV was associated with type 2 diabetes.

The researchers suggest that CMV could be either acting directly on pancreatic cells or indirectly by causing the immune system attacking the pancreas. Dr Andrea Maier, who led the investigation explained, " In our study we realised that although CMV seropositivity was associated with type 2 diabetes, higher levels of HnA1c and high non-fasting glucose the actual level of antibodies against CMV was not. "

This study is looking at the effect of CMV on the very old. By their very nature these people have had longer to become infected with CMV and have low risks for other factors which are linked to diabetes or to cardiovascular disease. While it may not be possible to extrapolate these findings to the general population it seems likely that finding a way to overcome CMV infections may reduce diseases, such as diabetes, later in life.

Tropical Storm Isaac is intensifying and now expected to make landfall late Tuesday or early Wednesday on the northern Gulf Coast as a hurricane, forecasters said on Monday.

The storm--with sustained winds of 65 mph--is moving northwest at 14 mph. According to the National Weather Service, New Orleans is in the projected path of the storm. Wednesday marks the seventh anniversary of Hurricane Katrina, which devastated New Orleans and the Gulf Coast in late August 2005.

Hurricane warnings have been issued along the northern Gulf Coast from Morgan City, La., to Destin, Florida. According to the National Hurricane Center, a storm surge between six and 12 feet could threaten the northern Gulf Coast if the storm makes landfall during high tide.

Isaac was blamed for as many as seven deaths in Haiti on Saturday and forced the delay of the start of the Republican National Convention in Tampa, where GOP leaders are still mulling how to hold a convention as a hurricane concurrently thrashes the Gulf Coast.

"Even if the storm largely bypasses this region," the New York Times said, "it holds the risk of creating an uncomfortable split-screen image, especially if it continues barreling toward New Orleans."

Indeed, several news organizations, including CNN, have already sent staffers to the Big Easy to cover the storm. And the Boston Globe, citing senior Romney advisers, said that "there is a distinct possibility that the 2012 Republican National Convention will be cancelled."

"Consider for a moment the juxtaposition of President Obama marshaling his administration's forces and personally visiting New Orleans or Mobile, Ala., in the aftermath of the storm's landfall," the Boston Globe said, "all while the convention hall is filled with delegates dressed in funny hats listening to partisan speeches."

On Sunday, Louisiana Gov. Bobby Jindal declared a state of emergency and ordered voluntary evacuations of more than a dozen parishes. Governors in Alabama and Mississippi did, too.

"I know the anxiety level is high," New Orleans Mayor Mitch Landrieu told CNN on Sunday. "We are much, much better prepared structurally than before."

A big issue is Isaac's speed. According to Weather.com, the storm is expected to slow as it approaches Louisiana, and could take up to 36 hours--perhaps longer--to move through New Orleans.

New Home Construction In Connecticut Sees Another Gain In July ...

Permits issued for new housing units in Connecticut rose again in July, pushing totals so far this year nearly 40 percent higher than the same period in 2011, according to a new report today.

The new construction provides a bit of relief from last year when residential building hit its lowest levels in decades, as housing struggled to stabilize.

Towns and cities issued permits for 2,092 single-family houses, condominiums and apartment units for the first seven months of the year, according to the state Department of Economic and Community Development. That represents a 39-percent increase from the 1,508 units approved by local building officials for the same period a year ago.

Even so, this year?s pace is still well behind the 6,000 to 8,000 units that real estate experts consider to be a healthy residential building market. Construction is being held back, at least in part, by weak demand, although sales have picked up in recent months.

Permits have increased each month this year, with the exception of March, which was flat. In July, the number of permits rose 31 percent, to 375 from 258 a year ago.

A little over half of the new units were single-family houses.

I have vision insurance. It helps me cover the cost of lens fitting. I wear lenses because there are many things that I can?t do while wearing glasses. And since lenses are more expensive than glasses, it?s best to get vision insurance as it covers a large part of eye exam and lens fitting costs.

Do a money/time analysis

They also let you compare their prices with their competitors? prices so that you can know how much you are saving. Plus you might find some extras on eye wear for the same price, like scratch resistant coating, anti-glare lens, thinner lenses, and sunglass tinting etc.

Campbell&#39;s Soup&#39;s New Direction Inspired By Food Trucks

When Campbell's Soup realized it was slipping in popularity, the company's new CEO, Denise Morrison, was charged with revitalizing the brand. One source of inspiration? Food trucks.

The Star-Ledger reports that Morrison, who has helped roll out about 50 new Campbell's products, enlisted a consumer insights group to better understand young consumers, which are the audience Campbell's is most quickly losing.

Chuck Vila, the vice president of consumer insights, visited "hipster hubs" in Austin, Portland and San Francisco, noshing at food trucks and neighborhood eateries, among other things.

From that research, Campbell's went on to develop ethnic-influenced, gourmet-sounding and easy-to-prepare soups and sauces. The packaging on these products is a far cry from the brand's iconic red and white design. A new line of Campbell's Go! Soup products are in a pouch, not a can (for quick microwaving) and come in flavors like Coconut Curry with Chicken and Shitake Mushrooms and Moroccan Style Chicken with Chickpeas.

Earlier this year, Morrison spoke at the Consumer Analyst Group of New York conference, stressed that although Campbell's canned soups are the company's first priority, growth is important:

When we talk about our U.S. soup strategy, we talk about first celebrate the can, then expand soup beyond the can, and then expand them to the greater simple-meals arena.

Morrison is likely banking on the success of her new products -- the New York Times reported in May that Campbell's had slipped five percent in its most recent quarter.

U of S and Saskatchewan Blue Cross announce $1-million - blog*spot

The University of Saskatchewan has announced an exciting partnership with Saskatchewan Blue Cross to curb childhood obesity in the province. Enabled by the generous $1-million investment of Saskatchewan Blue Cross, the College of Kinesiology will launch the Mind, Exercise, Nutrition, Do It (MEND) program in Saskatchewan this September.

MEND is a program that has evolved into one of the most successful and internationally recognized obesity prevention initiatives in the past decade with programs in the United Kingdom, Canada, United States, Australia, New Zealand and Denmark.

In Saskatchewan, the program will begin as a three-year project, starting with Saskatoon in the first year and expanding to Prince Albert and northern communities in year two. In its third year, it will expand throughout the province to include Regina and southern regions. The programs are provided free of charge through the support of donors like lead partner Saskatchewan Blue Cross, and will offer three streams, focusing on children aged two to four, five to seven and seven to 13.

Together with their parents, children learn about topics that range from nutrition and portion size to motivation and goal setting. Additionally, children participate in group physical activity while parents discuss ways to improve the overall health of their families.

Death toll from bomb in Turkey rises to 9

ISTANBUL (AP) ? A 12-year-old girl became the ninth victim Tuesday of a bomb blast in Turkey's southeast, which has highlighted fears that Kurdish rebels seeking self-rule are becoming emboldened by moves toward autonomy by the Kurdish minority in war-torn Syria.

Deputy Prime Minister Besir Atalay said the girl had died of her wounds and three other children were among those killed when a bomb concealed in a vehicle exploded Monday night near a police station in the city of Gaziantep, near the Syrian border, where tens of thousands of refugees are sheltering in Turkish camps.

Dozens more were wounded in the blast, which occurred on a Muslim holiday and came amid an increase in fighting in recent weeks between Turkish forces and Kurdish rebels who took up arms in 1984.

There was no claim of responsibility, and Firat, a pro-Kurdish news agency, cited militants as saying they were not involved and guerrilla forces would not attack civilians. However, Turkish Interior Minister Idris Naim Sahin said any disavowal by the rebel Kurdistan Workers' Party, or PKK, was not credible, according to Turkey's NTV television. Kurdish militants have previously targeted civilians, and the PKK is deemed a terrorist group by Turkey and its Western allies.

"The fact that the PKK has not claimed the attack does not mean that it didn't do it," Sahin said during a visit to Gaziantep. "The attack has links within and outside of Turkey."

Turkey has conducted periodic air strikes against Kurdish rebel bases in the mountains of northern Iraq, but is now concerned that the guerrillas are organizing in Kurdish-dominated parts of Syria sympathetic to their cause, and where regime forces have pulled back as they struggle to quell a national uprising. Fighters from a Syrian Kurd group have set up checkpoints and hoisted Kurdish flags in some areas near Turkey, and Turkish forces have staged several drills on their side of the border in a show of force.

The complexity of the situation partly explains Turkish reservations about using troops to establish a buffer zone inside Syria to protect civilians fleeing attacks by forces loyal to Syrian President Bashar Assad. Turkey nearly went to war with Syria over its support for the PKK when the rebel group was much more powerful in the 1990s, and it worries that Syrian Kurd moves toward autonomy could encourage Turkish Kurds to escalate their own campaign for self-rule in its southeast.

Within its borders, the Turkish state has granted more cultural rights to Kurds, who make up some 20 percent of Turkey's population of 75 million, but there is still a great deal of distrust between Ankara and many Kurds, who say they are treated poorly and remain a target of prosecution. Iran also has a large Kurdish minority, and Iraqi Kurds have carved out their own mini-state in northern Iraq.

Political analyst Wladimir van Wilgenburg said it would be difficult for the PKK to conduct attacks on Turkish targets from bases inside Syria because the border area is flat and relatively easy to control, unlike the rugged region between Turkey and Iraq. In addition, the border between Turkey and Syria is heavily mined and monitored.

"The PKK cannot use the Syrian Kurdish areas as a launching pad against Turkey and only controls limited areas where Syrian security forces are still present to some degree," van Wilgenburg wrote in an analysis published this month by The Jamestown Foundation, a US-based research center. "The PKK may aim to gain more legitimacy by playing a role in Syria, but not to use their presence there against Turkey militarily."

In a meeting with Turkish journalists last week, Francis J. Ricciardone, the U.S. ambassador to Turkey, expressed concern about reports of arms shipments by Iran to the Syrian regime, an ally, and referred to the traditionally "good relations" between the Assad regime and the PKK. He described recent U.S. sanctions against the Lebanese militant group Hezbollah as an attempt to prevent the Syrian regime "or its fellow travelers like the PKK" from getting aid in the form of arms, logistical support and intelligence.

Deadline intensifies pressure on Mo. congressman

ST. LOUIS (AP) ? Rep. Todd Akin vowed to fight on in his embattled Senate campaign, but a significant deadline loomed Tuesday that was bound to intensify pressure on the Missouri congressman to abandon the race over his comments that women's bodies can prevent pregnancies in cases of "legitimate rape."

Akin has been frantically trying to salvage his once-promising bid against incumbent Democrat Claire McCaskill in a race long targeted by the GOP as crucial to regaining control of the Senate. But ominous signs were mounting against the six-term legislator from suburban St. Louis, most notably the apparent loss of millions of dollars in campaign advertising money.

Early Tuesday Akin posted a video online in which he apologized but made no mention of the race. He went on two conservative radio shows Monday, pledging to keep the campaign alive, even as some from within his own party urged him to step aside.

The decision has some urgency. Missouri election law allows candidates to withdraw 11 weeks before Election Day. That means the deadline to exit the Nov. 6 election is 5 p.m. Tuesday. Otherwise, a court order would be needed to remove a name from the ballot.

"I was told the decision has to be made by 5 tomorrow, but I was calling you and letting you know that I'm announcing today that we're in," Akin told radio host Sean Hannity.

In a radio interview with former Republican presidential candidate Mike Huckabee, Akin repeatedly apologized for the remarks but also vowed to stay in the race.

"The good people of Missouri nominated me, and I'm not a quitter," Akin said.

The uproar began Sunday, when St. Louis television station KTVI aired an interview in which Akin was asked if he would support abortions for women who have been raped.

"It seems to me, first of all, from what I understand from doctors, that's really rare. If it's a legitimate rape, the female body has ways to try to shut that whole thing down," Akin said.

Later Sunday, Akin released a statement saying that he "misspoke" during the interview.

In the interviews with Huckabee and Hannity, Akin acknowledged that rape can lead to conception.

"Rape is never legitimate. It's an evil act. It's committed by violent predators," Akin said. "I used the wrong words the wrong way."

But the damage had been done. The comments drew a sharp rebuke from fellow Republicans, including presumptive presidential nominee Mitt Romney and his vice presidential choice, Rep. Paul Ryan, of Wisconsin.

The Senate's top Republican, Mitch McConnell, said Akin's comments might "prevent him from effectively representing" the Republican Party. He called on Akin to "take time with his family" to consider whether he should continue in the Senate race.

Two other Republican senators, Scott Brown of Massachusetts and Ron Johnson of Wisconsin, urged Akin to resign.

Akin also apparently lost a key source of funding. Sen. John Cornyn, head of the National Republican Senatorial Campaign Committee, told Akin that $5 million in advertising set aside for Missouri will be spent elsewhere and that Akin will get no other help from the committee, according to a committee official who spoke on condition of anonymity because the conversation was private.

Cornyn told Akin that he was endangering the GOP's hopes of getting a Senate majority by staying in the race, the official said.

At least one political interest group that has pounded McCaskill with attack ads, the Karl Rove-backed American Crossroads, also pulled its ads from Missouri.

The apology video Akin posted on YouTube early Tuesday, in which he describes himself as a compassionate father of two daughters, was an apparent attempt to claw back some of that funding.

"Fact is, rape can lead to pregnancy. The truth is rape has many victims. The mistake I made was in the words I said, not in the heart I hold. I ask for your forgiveness," he said in the video.

President Barack Obama said Monday that Akin's comments underscore why politicians ? most of whom are men ? should not make health decisions on behalf of women.

"Rape is rape," Obama said. And the idea of distinguishing among types of rape "doesn't make sense to the American people and certainly doesn't make sense to me."

It was just two weeks ago that Akin was at the top of the political world in Missouri after winning a hotly contested three-way battle with millionaire businessman John Brunner and former state Treasurer Sarah Steelman for the right to challenge McCaskill in the November election. Missouri has grown increasingly conservative in recent years, and McCaskill is seen as vulnerable.

She was not among those calling for her opponent to get out of the race.

"What's startling to me is that (Republican) Party bigwigs are coming down on him and saying that he needs to kick sand in the face of all the primary voters," McCaskill said at a campaign event Monday in suburban St. Louis. "I want Missourians to make a choice in this election based on policy, not backroom politics."

One anti-abortion group expressed support for Akin, while another called on him to step aside.

Missouri Right to Life, which opposes a woman's right to get an abortion even in cases of rape and incest, said Akin's "consistent defense of innocent unborn human life clearly contrasts with the anti-life position of Senator Claire McCaskill."

But the Christian Defense Coalition called on him to withdraw. The coalition's leader, the Rev. Patrick J. Mahoney, called Akin's comments "offensive, repugnant and troubling."

Names are being floated about a possible replacement for Akin. A favorite is Tom Schweich, the state auditor who was courted to run for Senate earlier this year but declined.

Other names mentioned include former Sen. Jim Talent, who lost to McCaskill in 2008; former Gov. Matt Blunt, the son of Missouri's other senator, Roy Blunt; two members of Missouri's House delegation, Blaine Luetkemeyer and Jo Ann Emerson; and Akin's two unsuccessful primary opponents, Brunner and Steelman.

Talent, who lost his seat to McCaskill in 2006, said Monday he had been asked to run but replied: "I'm not running for the Senate."

"I'm totally ruling it out," Talent said in Tampa, Fla.

University of Missouri-St. Louis political scientist Dave Robertson said any candidate who might replace Akin would face significant challenges so close to the election.

"You're going to be on the defensive and starting from behind with a very short time to go," Robertson said.

Missouri has faced awkward situations in Senate elections before. In 2000, Democratic candidate Mel Carnahan died in a plane crash three weeks before the November election. His name remained on the ballot and he defeated Republican incumbent John Ashcroft.

Carnahan's widow, Jean, served for two years before losing in a special election to Talent.

If Akin were to leave, state law gives the Republican state committee two weeks to name a replacement. The new candidate must file within 28 days of Akin's exit.

The American Congress of Obstetricians and Gynecologists said a woman who is raped "has no control over ovulation, fertilization or implantation of a fertilized egg (i.e., pregnancy). To suggest otherwise contradicts basic biological truths."

Between 10,000 and 15,000 abortions nationwide occur each year among women whose pregnancies resulted from rape or incest. An unknown number of babies are born to rape victims, the group said.

Research on the prevalence of rape and rape-related pregnancies is spotty. One estimate published in 1996 said about 5 percent of rapes result in pregnancy, or about 32,000 pregnancies among adult women each year.

Still, the idea about rape and pregnancy has been raised in anti-abortion circles for at least three decades.

Leon Holmes, onetime head of Arkansas Right to Life, wrote in a 1980 letter to a newspaper that concern for rape victims "is a red herring because conceptions from rape occur with the same frequency as snow in Miami." Holmes went on to become a federal judge.

Abortion foes in the Pennsylvania and North Carolina legislatures have made similar statements. And in Arkansas in 1998, Republican Senate candidate Fay Boozman came under fire for saying pregnancies from rape were uncommon. He apologized and later acknowledged that his unsuccessful campaign never recovered from the criticism. He died in 2005.

It is the year 9043 A.D. The Genetic-hybrid program has successfully wiped out the Predator, Xenomorph, and Symbiote civilizations. Steve Jobs' stolen iPad unwittingly used by 'Kenny the Clown' after burglary

What would you do if you had Steve Jobs' iPad? Kenny the Clown, who had the late Apple (AAPL) co-founder's tablet all to himself for a few days this month, didn't play any games, surf the net or check for any top-secret corporate documents.

Instead, he loaded iTunes to play the "Pink Panther" theme song and Michael Jackson, using the magical device to entertain Bay Area kids and tourists during his clown routine.

He had no idea the device came from the fabled Jobs residence until after the friend who gave him the gadget was charged with breaking into the CEO's Palo Alto home. By then, the cops had already shown up at his door and taken it away.

"It would be like getting a football from Joe Montana that was stolen out of his house," said the 47-year-old professional clown, whose real name is Kenneth Kahn. "It's bizarre; it's really bizarre."

Police said Kariem McFarlin, a 35-year-old Alameda resident, gave Kahn a silver 64GB iPad that was stolen out of the Waverley Street home on July 17. McFarlin also allegedly gave another iPad to his daughter, and both devices were returned to the Jobs family after McFarlin was arrested on Aug. 2, police said.

McFarlin is accused of stealing iPods, Macs, Tiffany & Co. Jewelry,

and even Jobs' wallet and driver's license by using a spare key he found on the property to break into the home, which was under construction. The heist has sparked international media attention since being revealed by this newspaper late Monday.

Kahn had played around with plenty of iPads at Apple stores and thought he had just gotten an old device McFarlin wanted to get rid of, assuming his friend had purchased a newer-version iPad.

"I didn't notice anything special or anything like that," said Kahn, adding he had the iPad for three or four days before police asked for it back. "It was silver; it looked normal. I was basically using it like an iPod."

Kahn -- who unsuccessfully ran for mayor of his hometown Alameda in 2006 and 2010 and for San Francisco mayor in 2007 -- met McFarlin when he coached him on the Encinal High School basketball team in Alameda more than 10 years ago, and they remained close.

He said McFarlin is not "any type of menace" and before the story hit the news, his friends figured it was a case of mistaken identity.

"He's a nice guy who made a horrible, horrible decision," Kahn said. "I wish I could ask him: 'What were you thinking?'"

McFarlin is due in court Monday where he will be represented by a recently hired private attorney. The public defender's office, which is still officially representing McFarlin, declined to comment and said McFarlin's new attorney wants to remain anonymous until Monday's hearing.

Court records show McFarlin pleaded guilty in Santa Clara County Superior Court in 1999 to driving without a license, a misdemeanor that netted him fines and a year of probation. The former San Jose State football player was also arrested by Pleasant Hill police last year on suspicion of stealing but prosecutors never filed charges.

"Before the public sees him as this horrible monster, I'd like to hopefully think we can somehow get across that he just made the worst mistake of his life," Kahn said.

McFarlin, who police say confessed to the crime, remained in jail Thursday in lieu of $500,000 bail. Apple and the Jobs family have declined to comment.

"It still hasn't really 100 percent set in for me. It was Steve Jobs' iPad -- literally," Kahn said. "If this thing weren't so tragic, it would be comical."

Baseball star Eddie Murray settles SEC insider trading charges

NEW YORK (Reuters) - U.S. securities regulators on Friday charged Hall of Fame baseball player Eddie Murray with insider trading in shares of a medical device company, an allegation the former Baltimore Orioles first baseman settled by paying a $358,151 penalty.

The Securities and Exchange Commission also filed civil charges against two other people, accusing them of insider trading in shares of Advanced Medical Optics before the company announced it was being acquired in 2009 by Abbott Laboratories.

Murray, elected to the Baseball Hall of Fame in 2003, agreed to settle the civil charges without admitting wrongdoing, according to an SEC announcement.

"Eddie Murray is admitting no wrongdoing whatsoever - the settlement agreement confirms that fact," Murray's lawyer, Michael Proctor, said. "He has settled this to put the case to an end and get on with his life."

Reuters had previously reported Murray was under investigation in the case as part of a broader look into potential insider trading by former professional athletes.

The SEC also filed charges against James V. Mazzo, who was the chief executive officer of Advanced Medical Optics at the time of the buyout, and a Utah businessman, David Parker. The agency said Mazzo and Parker are fighting the charges.

The SEC has accused Mazzo, an avid baseball fan and friend of another former Orioles team member, Doug DeCinces, of tipping the former player on the deal. DeCinces then passed the information to Murray and Parker, according to the SEC announcement.

"Mazzo had repeated personal contacts and communications with DeCinces, who promptly traded and tipped Murray, Parker and others that a deal involving Mazzo's company was imminent," said Daniel M. Hawke, chief of the SEC Enforcement Division's Market Abuse Unit and director of the Philadelphia Regional Office.

Mazzo's lawyer, Richard Marmaro, said Mazzo "flatly and unequivocally denies the SEC's allegations".

"Mr. Mazzo has a spotless reputation for professionalism, integrity, and service to his community, built up over a career of 30 years. The notion that he would put all that at risk to give a single friend inside information is absurd," Marmaro said.

Parker's lawyer, James Sanders, declined to comment.

The SEC filed charges against DeCinces in August 2011. DeCinces settled with the SEC, agreeing to pay $2.5 million in fines, while neither admitting nor denying wrongdoing in the trading of Advanced Medical Optics shares. A lawyer for DeCinces did not respond to a request for comment.

DeCinces and Murray played together on the Orioles from 1977 to 1982.

"It is truly disappointing when role models, particularly those who have achieved so much in their professional careers, give in to the temptation of easy money," Hawke said.
